Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and StartupScale ("StartupScale", "we", "us", or "our"), the operator of the website and service available at https://startupscale.app (the "Service"). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them.

If you are using the Service on behalf of a company or other organization, you represent that you have the authority to bind that organization, and "you" refers to both you and that organization. If you do not agree with any part of these Terms, you must not access or use the Service.

These Terms incorporate our Privacy Policy by reference. Please read the Privacy Policy carefully to understand how we collect, use, and share information when you use the Service.

StartupScale is an AI-powered competitor and startup analysis tool. You enter a company or product URL, and within roughly five minutes we generate a structured intelligence report about that company.

A report may include the company's business model, estimated website traffic (monthly visits, traffic sources, geographic and device breakdown), detected technology stack, marketing analysis (such as a SWOT summary, channels, and tools), UI and UX style observations (such as colors and typography), an overall evaluation score, likely competitors, pricing tiers, and publicly reported funding and news.

To build these reports, the Service combines proprietary data collection and analysis with third-party data sources and artificial intelligence. These sources currently include SimilarWeb (traffic estimates), Wappalyzer and automated browsing for technology detection, automated web scraping of public pages such as About and Pricing pages, Perplexity for multi-source research, and Google Gemini to synthesize the gathered information into the final report.

We may add, change, or remove features, data sources, or report sections at any time as the Service evolves.

You must be at least the age of majority in your jurisdiction and legally able to enter into a binding contract to use the Service. The Service is intended for business and professional use, such as competitive research and market discovery by founders, marketers, investors, and product managers.

Accounts are created and authenticated through Sign in with Google, provided via Supabase Auth. When you sign in, we receive basic profile information associated with your Google account, such as your name, email address, and avatar.

You are responsible for all activity that occurs under your account and for maintaining the security of the Google account you use to sign in. You agree to provide accurate information, to keep it current, and to notify us promptly at contact@startupscale.app if you believe your account has been accessed without your authorization. We are not liable for any loss arising from unauthorized use of your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service, including the URLs and domains you submit for analysis, complies with all applicable laws and the rights of third parties.

The Service is offered through a Free plan and paid subscription plans, currently Starter and Pro. The Free plan provides a limited preview of a report. Paid plans unlock the full report, comparisons, and deeper analysis. The specific features, usage limits, and prices of each plan are described on our pricing page and may change from time to time.

Payments for paid plans are processed by our payment provider, Stripe. By subscribing to a paid plan, you authorize us and Stripe to charge your selected payment method for the applicable fees. We do not store your full payment card number; payment details are handled by Stripe, and we retain only limited payment metadata necessary to manage your subscription.

Paid subscriptions renew automatically at the end of each billing period (for example, monthly) at the then-current price, unless you cancel before the renewal date. You can cancel at any time through your account billing settings or the Stripe customer portal. When you cancel, your plan remains active until the end of the current billing period, and you will not be charged for the following period.

Except where required by applicable law, fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused features, or unused report allowances. If we materially increase the price of a plan, we will give you advance notice and an opportunity to cancel before the change takes effect. You are responsible for any taxes associated with your subscription, except for taxes based on our net income.

The Service, including its software, design, text, graphics, user interface, and the methods used to generate reports, is owned by StartupScale or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all right, title, and interest in and to the Service.

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and to use the reports you generate for your own internal business purposes.

You may share an individual report internally within your organization, but you may not resell reports, present them as your own commercial product, or distribute them publicly in a way that competes with the Service. Trademarks, logos, and brand names that appear in reports belong to their respective owners and are referenced for identification and informational purposes only; their appearance does not imply any affiliation with or endorsement of StartupScale.

If you submit feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or obligation to you.

Reports generated by the Service aggregate information from third-party data sources and apply automated and AI-based analysis to it. Traffic figures, technology detections, funding details, competitor lists, scores, and other elements are estimates and interpretations, not verified facts. Third-party data may be incomplete, outdated, or inaccurate, and AI synthesis can produce errors or omissions.

All reports and other output of the Service are provided on an "as is" and "as available" basis and are for informational purposes only. We do not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any report or any data it contains.

Nothing produced by the Service constitutes professional, financial, legal, investment, tax, or business advice, and it should not be relied upon as such. You are solely responsible for independently verifying any information before making decisions based on it. Your use of any report and reliance on its contents is entirely at your own risk.

The Service depends on, integrates with, and links to services operated by third parties, including those used for hosting, authentication, payments, analytics, research, and data collection. Your use of those services may be subject to their own terms and policies, and we are not responsible for their availability, content, or practices.

We do not control third-party data sources and cannot guarantee continued access to them. If a third-party provider changes, limits, or discontinues its service, the availability, scope, or quality of certain report features may be affected, and we may modify or remove those features accordingly.

To the maximum extent permitted by applicable law, StartupScale and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to us for the Service during the three months immediately preceding the event giving rise to the claim, or fifty United States dollars (USD 50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In that case, our liability is limited to the smallest extent permitted by law.

You agree to defend, indemnify, and hold harmless StartupScale and its operator from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, your violation of any applicable law, or your infringement of the rights of any third party, including in connection with the URLs you submit and the way you use any report.

You may stop using the Service at any time and may cancel your subscription and delete your account through your account settings or by contacting us. We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if you breach these Terms, if your use creates risk or legal exposure for us, or if we are required to do so by law.

Upon termination, your right to access and use the Service ends. Provisions of these Terms that by their nature should survive termination, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply after termination.

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the effective date below and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of laws principles, and you agree that the courts located in the Republic of Korea will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable mandatory law provides otherwise.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be considered a waiver of that right or provision.
